1. The Service

Serenova ("we", "us", "our") is a mobile application that provides daily affirmations, guided breathing exercises, mood tracking, psychological self-assessments, ambient sounds, premium themes, a Home Screen widget, and related features (collectively, the "Service"). By downloading, installing, or using the Service you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms form a binding contract between you and Serenova (the operator of the Service, based in Türkiye).

2. Eligibility

You must be at least 9 years old to use the Service and at least 13 years old (or the higher minimum age in your jurisdiction, e.g., 16 in some EEA countries) to create an account. By using the Service you confirm that you meet these requirements and that any information you provide is accurate. If you are using the Service on behalf of a minor for whom you have parental responsibility, you accept these Terms on their behalf.

3. Your Account

• You are responsible for activity that occurs under your account.
• Keep your sign-in credentials confidential. We will never ask for your password.
• If you suspect unauthorised access, write to support@getserenova.app immediately.
• You may have only one personal account at a time.

4. Subscriptions, Free Trial & Auto-Renewal

By starting a subscription you authorise Apple to charge the corresponding amount to your Apple ID account at the start of each billing period. Subscriptions begin immediately upon successful purchase (or, if a free trial applies, at the end of the trial unless you cancel).

5. Cancellation & Refunds

How to cancel

1. Open the iOS Settings app.
2. Tap your name at the top.
3. Tap Subscriptions.
4. Select Serenova.
5. Tap Cancel Subscription.

Cancellation prevents future renewal charges. You keep access to Serenova Plus until the end of the current paid period.

Refunds

All refund requests for App Store purchases are handled by Apple. You can request a refund at reportaproblem.apple.com. Apple's decision on refunds is final under their App Store terms. We are unable to issue direct refunds for App Store transactions. We may, at our discretion, advocate on your behalf with Apple if you write to us at support@getserenova.app.

Lifetime purchase

The Lifetime plan is a single one-time purchase that grants ongoing access to Serenova Plus on the platforms and accounts where it was purchased, for as long as the Service continues to operate. It does not auto-renew. Refund requests follow the same Apple-administered process described above.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in any way that could harm others.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Bypass, disable, or interfere with subscription, security, or licensing mechanisms.
• Upload or transmit malicious code or attempt to disrupt the Service.
• Use the Service to harass, abuse, or harm another person, or to violate the rights of others.
• Resell, sublicense, or commercially exploit the Service or its content.
• Use the Service in a way that violates Apple's App Store guidelines or applicable law.

7. Content & Intellectual Property

All content provided through the Service — including affirmation text, audio, illustrations, photographs, themes, psychological assessments, software, and the Serenova name and logo — is owned by Serenova or licensed to us, and is protected by copyright, trademark, and other intellectual-property laws.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms and the App Store Terms.

Content you create within the app (mood entries, favourites, notes) belongs to you. You grant us a worldwide, royalty-free licence to host, store, display, and back up that content solely for the purpose of providing the Service to you. We do not use your content for any other purpose, do not sell it, and do not use it to train AI models.

8. Health & Wellness Disclaimer

Serenova is a wellness product, not a medical device. The Service does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional care. Affirmations, breathing exercises, mood logging, and self-assessments are intended for general wellness, education, and self-reflection only. Do not rely on the Service for medical decisions.

If you are experiencing a mental-health crisis, please contact a qualified healthcare provider or local emergency services. In the United States, you can dial or text 988. In the EU, dial 112. In Türkiye, dial 112.

9. Apple Devices, App Store & Third Parties

The Service is licensed, not sold. Your licence is subject to your prior acceptance of Apple's Licensed Application End User License Agreement (the "Standard EULA") available in the App Store's terms. The following provisions apply with respect to your use of the Service on Apple devices:

• These Terms are concluded between you and Serenova only, and not with Apple. Apple is not responsible for the Service or its content.
• Your use of the Service must comply with the Apple Media Services Terms and Conditions and the App Store Terms of Service.
• Apple has no obligation to provide maintenance and support services with respect to the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever.
• We, not Apple, are responsible for addressing any claims you or any third party have relating to the Service or your possession and use of it, including product-liability, regulatory-compliance, and consumer-protection claims.
• In the event of any third-party claim that the Service or your use of it infringes that party's intellectual-property rights, Serenova (and not Apple) will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Termination

You can stop using the Service at any time by deleting the app and your account. We may suspend or terminate your access if you violate these Terms or if your conduct could reasonably harm the Service or other users. Upon termination, your licence to use the Service ends. Sections that by their nature should survive (intellectual-property, disclaimers, limitation of liability, governing law) survive termination.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise — including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, free of harmful components, secure, or that any defects will be corrected. Your use of the Service is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by law, Serenova and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, business, or goodwill, whether incurred directly or indirectly. Our total cumulative liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid Serenova in the twelve months before the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not fully apply to you; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Serenova and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of or inability to use the Service, (b) your violation of these Terms, or (c) your violation of any rights of a third party.

14. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. The courts of Istanbul (Türkiye) shall have exclusive jurisdiction over any dispute arising out of these Terms, except where mandatory local consumer-protection law grants you stronger rights — in which case those rights apply.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you in the app or by email at least 14 days before the changes take effect. Continued use of the Service after the effective date means you accept the revised Terms. If you do not accept, your remedy is to stop using the Service.
